HYDERABAD EMERGENCY MEETING DETAILS

THE EMERGENCY GENERALBODY MEETING OF ALL STATE COORDINATORS AND AP STATE SSA COORDINATORS MEETING MEETING WAS HELD AT MUSHEERABAD EXCHANGE ,HYDERABAD ON 28/12/2009 UNDER THE CHAIRMANSHIP OF SRI.Y.RAMAKRISHNA RAO.THE MEETING WAS A GRAND SUCCESS.

THE FOLLOWING RESOLUTIONS WERE PASSED IN THE MEETING.

1.AFTER ISSUING THE NOTIFICATIONS FOR CONDUCTING THE JTO LICE 35% AND 15% QUOTA BY CIRCLES ..ALL OF US SHOULD PROTEST THROUGH INDIVIDUAL REPRESENTATIONS TO CGMT OF THE CIRCLE AND CMD BSNL STATING THAT UNTIL UNLESS REGULARISATION OF QUALIFIED TTAs TO JTO WAS NOT COMPLETED ,THE EXAM SHOULD NOT BE CONDUCTED.

2.IMPLEMENTATION OF FR22(1)A1 SCALE FOR OFFICIATING JTOs(JUDGEMENTS GIVEN BY PRICIPAL CAT AND EARNAKULAM CAT):
THE BSNL MGMT IS IMPLEMENTING THE JUDGEMENTS OF SOME COURTS LIKE CHANDIGARH(FOR STOPPAGE OF DIVERSION) AND KERALA (FOR CONDUCTING OF JTO EXAMS)FAVOURING ONESIDED WITH OUT APPEALING IN HIGHER COURTS AND APPEALING IN HIGHER COURTS IN OUR CASES,IT INDICATES CLEAR BIAS AND ONE SIDE FAVOURING.THIS TYPE OF WORKING SHOULD NOT BE THERE FROM MANAGEMENT SIDE AND WE ARE REQUESTING THE MANAGEMENT TO WORK UNIFORMLY FOR ALL CASES.

3.THE MEETING ALSO DECIDED TO DEMAND THE MANAGEMENT THAT BEFORE CONDUCTING THE JTO LICE 35% AND 15% ALL THE QUALIFIED TTAs SHOULD BE REGULARISED AS JTOs.THIS ASSOCIATION ALSO RESOLVED TO CONDUCT ONE DAY DHARNA AT CORPORATE OFFICE ,NEW DELHI SHORTLY WITH THE COOPERATION OF ALL UNIONS /ASSOCIATIONS WHO ARE SUPPORTING OUR ISSUE.

4.WHEN WE ARE ASKING THE MANAGEMENT TO REGULARISE US THEY ARE TELLING THAT THE MATTER IS IN THE COURTS AND SUB-JUDICE,WHEN IT IS SUB-JUDICE THEN HOW THE AMANAGEMENT ISSUED AMENDMENT TO THE JTO RR-2001.IT SHOULD BE EXPLOITED AT EVERY STAGE.MANAGEMENT IS TELLING THAT THIS AMENDMENT WAS TAKEN BY THE NATIONAL COUNCIL REPRESENTATION.WE ARE QUESTIONING THE MANAGEMENT WHY IT IS NOT HONOURING THE DECISIONS TAKEN BY NATIONAL COUNCIL AND THREE FEDERATIONS TO DIVERT THE VACANCIES FROM DIRECT QUOTA TO DEPT QUOTA TO REGULARISE ALL QUALIFIED AND TRAINED OFFICIALS FROM TTA CADRE.

5.OUR ASSOCIATION DEMAND THAT THE VACANCIES OF 1991 TO 2002 UNDER DEPT QUOTA SHOULD BE FILLED BY QUALIFIED OFFICIALS ONLY AND FOR JTO LICE 35% QUOTA EXAM ..AS PER 7 YEARS SERVICE CONDITION ONLY 2008 YEAR VACANCIES SHOULD ONLY BE FILLED BY EXAM.THIS ASSOCIATION ALSO RESOLVED IF THE EXAM IS CONDUCTED IN THE YEAR 2003 OR 2004 MAXIMUM ELIGIBLE OFFICIALS ARE ALREADY AVAILABLE WHICH WAS NEGLECTED AT THAT TIME BY THE MANAGEMENT

6. BE ALERT EVERY BODY AND ALL STATE COORDINATORS ARE ASKED TO FILE COURT CASES IF THE EXAM DATE IS ANNOUNCED BY CGMTs.
7.SOME IMPORTANT RESOLUTIONS WERE PASSED IN THE MEETING,ALL STATE COORDINATORS ARE REQUESTED TO CONTACT OUR CENTRAL COORDINATOR IMMEDIETLY.

8.AS PER THE RESOLUTION PASSED AT HYDERABAD ..ALL STATE AND SSA COORDINATORS ARE REQUESTED TO COLLECT MONTHLY SUBSCRIPTION OF Rs:100/ FOR THE ASSOCIATION FROM JANUARY-2010 ONWORDS.

THE NON-EXECUTIVES WAGE REVISION WAS POSTPONED TO 05-01-2010

PERSONAL UPGRADATION / NOTIFICATION OF 35%and 15% EXAMINATION

Dear friends you are well aware that the service condition for jto 35%and 15%LICE Examination was relaxed from 10 years to 7 years,we welcome the decision but we are demanding BSNL that it should take the decision regarding regularising the jto officiating officials by ONE TIME RELAXATION FOR PERSONAL UPGRADATION simultaniously,Other wise BSNL will be forced to invite the leagal problems through out the country.All the State and SSA coordinators are requsted to take nessasary steps for stopping the examination and the ammendment of jto 2001 RR to 2009 RR if department is proceeding the JTO exam with out regularising us and make that department can't conduct the exam without regularising us first.
This association conveys sincere thanks to sri K.VALLINAYAGAM G/S NUBSNLW(FNTO)for writing a letter to CMD BSNL FOR OUR LONG PENDING LIGITIMATE GININE DEMAND OF REGULAR PROMOTION.
OUR SUPRIMECOURT CASE hearing is expected after JAN 3rd 2010.It is only case filed (challenged) regarding stoppage of diversion of the posts only.We are trying our best for othermeans of regularising us at all levels.Don't get discoraged about departmental counter affidavit submitted to supreme court.Department has given the steps taken till today after chandigarh judgement in that affidavit.Don't worry....N.K.DAS....

The Central team of JTO(O) Association BSNL India Yesterday met Sri Kuppuswamy (former MP from Tamilnadu & President- LPF), Sri.Subburaman (General secretary TEPU) and Sri R.Venkataraman( president TEPU) and Sri Suresh kumar( G/S of BSNLMS) and apprised the situation of our issues.
Our Association team comprising Sri.kabeerdas ,Sri y.ramakrishna Rao, Sri.ch Ramsai , Sri P.S Chanda ,Sri Adam along with Sri Kuppuswamy, Sri Subburaman, Sri.R Venkataraman , Sri Suresh Kumar ,Sri B.R.Zakatia( G/S -All India SC/ST Welfare Association met Honble Minister of Communication Sri A.RAJA and explained the situation and requested for Personnel Up gradation of TTAs qualified in JTO screening test, respected MOC has given directions to his P.S sri. Srivastava (I.A.S) and Addnl P.A Sri Natarajan to resolve the issue. They have responded positively.
Our Central team also given letter to CMD,BSNL Sri Kuldeep Goyal for implementation of Principal CAT Delhi Judgement of FR22(1)A1 Pay Fixation(9850 scale) for officiating JTOs.
All the Coordinators met Sri. Prahladrai,( G/S AIBSNLEA), Sri Bhattacharya(Circle Secretary-Corporate office ) of SNEA and given Judgement copies of Principal CAT ,Delhi and requested to pressurise the management for implementation of the same.
Our team also met G/S and President of BSNLOA Sri S.C.GOUR AND SRI R.P.SARMA regarding “ SUBMISSION OF REJOINDER FOR THE 14TH DECEMBER HEARING in the SUPREME COURT,
Our association TEAM met Sri.Panth (GM-legal) through Sri Subburaman and Suresh kumar and pressurised him for filing SLP in the SUPREME COURT against Chandigarh Court judgement(5608).
The Wage Revision meeting will be held today at 16:00 hrs .We hope most probably it will be settled today it self. The management has proposed the new scale with the following formula

O.A.No.3213/2009 ORDER(Oral) By Shailendra Pandey. Member (A) Heard the counsel for the applicants.
1.It is stated by the counsel for the applicants that the applicant No.1 is a registered association . Applicant No 2.is posted as Junior Telecom Officer (JTO)in Hyderabad this Tribunal on 5.11.2009.
2.The facts in brief as stated by the counsel for the applicants are that all the applicants were initially posted as Telecom Technical Assistants (TTAs) Which is one of the feeder cadres for promotion to the post of JTO, and the applicants are governed by the Junior Telecom Officers Recruitment Rules, 1996. In the year 1999, new JTO Recruitment Rules, 1999 were framed which prescribed higher qualification for the said post of JTO for meeting high technology, Which were notified on 31.08.1999. On 10.11.1999,the Department of Telecom circulated a Memo for holding of JTO qualifying screening examination under 35% quota for the vacancies of JTO available up to 31.08.1999.A screening test was held on 23.4.2000 there in the applicants also appeared and were declared successful. While successful candidates were absorbed to the post of JTO up to the vacancies available as on 31.08.1999, the applicants were placed in the surplus candidates list (there were about6000 surplus candidates) due to non availability of vacancies. After formation of Bharat Sanchar Nigam Limited (BSNL) on 1.10.2000, the BSNL Board TOOK A DECISION ON 30.03.2001 TO ACCOMMODATE the surplus qualified candidates in 35% quota of screening test of JTO by diverting the 500 vacant post of JTO From direct recruitment to 35% departmental quota every year. The said diversion was a temporary one and subsequently the said post would revert back to direct recruitment quota. The BSNL FURTHER ISSUED AN OFFICE ORDER DATED 13.5.2004 IN TERMS OF WHICH THE TTAs WHO HAD SUCCESSFULLY completed JTO Phase-1 training were to be promoted temporarily to officiate locally as JTOs with immediate effect with minimum benefit of Rs 1000/-as per FR-35
3.It is the contention of the counsel that since the applicants were holding substantive post of TTAs and officiating and discharging higher responsibility of the post of JTO, their pay Should have been fixed according to the FR 22(1)(A)(1) as the applicants satisfied all the stipulations contained therein. She also submits that the issue involved in this OA has already been decided by the Ernakulum Bench of this Tribunal in TA Nos .84 to 97 of 2008 (M.V.Saililakumar& Ors. v The Chairman & Managing Director & Ors)decided on 15.07.2009. A copy of the judgement has been enclosed at annexure P6. She has further stated that the respondents have already implemented the said judgment and that the Chief General Manager Telecom M.P. Circle, Bhopal has also fixed pay scales of officiating JTOs Fundamental Rules 22(1)(A)(1) read with Fundamental Rule 26. According to her, the benefit given, needs to be extended to the applicants in this OA also view of Articles 14 and 16 of the constitution of india. It is stated that the applicants have submitted a representation (Annexure A8) to the respondents in the matter but action on the same is awaited.
4. In view of the aforesaid submission, WITHOUT GOING INTO THE MERITS OF THE CASE, WE ARE OF THE VIEW THAT THE INTEREST OF JUSTICE WOULD BE MET, IF THE PRESENT OA IS DISPOSED OF, at the admission stage itself, by directing the respondents to examine whether the cases of the applicants are covered by the aforesaid decision of the Ernakulum Bench (referred to above), and to pass appropriate orders accordingly, and if it is found otherwise to pass a reasoned and speaking order in the matter, under intimation to the applicants. THIS MAY BE DONE WITHIN FOUR WEEKS FROM THE DATE OF RECEIPT OF A COPY OF THIS ORDER. ORDERED ACCORDINGLY. NO COSTS.

GOOD NEWS FOR JTO(O) Association BSNL INDIA :The Principal CAT New Delhi gave a judgement on 11/11/09 over the case filed by us........OA No:3213/2009 &MA:1491/2009 in the matter of-Bharat Sanchar Nigam Limited officers association & Anr. Applicants (Mrs Rani Chhabra-Advocate) VERSUS CMD,BSNL & Respondants.
The Judgement was disposed.Petitioners pay was fixed under FR 35 causing reduction in their emoluments.As held by the single judgement of the high court(SUPRA)what is relevant in the matter of fixation of pay is whether the applicants (petitioners) are performing duties attatched to the posts of JTO`s having higher responsibilities.There is no dispute in this regard.Hence this OA succeed consequently.Respondants (CMD BSNL) are directed not to recover the pay and allowances already paid to the applicants in the scale of pay of JTO.They are further directed to continue to pay to the applicants pay and allwances due to them in the scale of pay JTO as per rule 22(1)(a)(1) of fundamental rule....With the aforesaid directions OA allowed.There shall be no order as to costs.Our associations thanks to Mrs RANI CHHABRA advocate and whoever cooperated for this court case particularly BTEF and BSNL OA unions and their PRESIDENT AND GENERAL SECRETARIES. The Application having been heard on 29.4.2009 the Tribunal delivered

the following :



O R D E R

This application is filed by the applicant aggrieved by the action

of the respondents in filling up the vacancies of JTO during 2003-04 under

the old 1996 Recruitment Rules.



2. The short facts are as follows. The applicant belonging to S.C

community was appointed as Technician under the 1st respondent w.e.f.

25.1.1993, promoted as Telecom Technical Assistant w.e.f. 28.9.1996.

All the promotion quota vacancies of JTO before 31.8.1999 were filled up in

accordance with the old Rules except vacancies reserved for SC/ST. As

per the JTO Recruitment Rules 1999, which came into effect w.e.f.

31.8.1999, 50% promotion quota is filled up (i) 35% through screening

test from specified categories possessing Degree of Engineering or in

Science with Physics and Chemistry or Diploma in certain subjects in

Engineering with 10 years regular service in a Group-C post and (ii) 15%

through competitive examination from candidates other than

PI/AEA/WO/TA /TTA/Sr. TOA with plus two and Diploma in Engineering on

specified subjects. In order to fill up the backlog vacancies remaining in

the 35% quota, a screening test was conducted on 30.4.2000. Even

though there was no vacancy for general category candidates in 35% quota

upto 31.8.1999, the 1st respondent permitted general category candidates

to appear in the qualifying test. The 5th respondent is one of the candidates

who qualified in the qualifying test conducted on 30.4.2000. It is

apprehended that the respondents are going to depute the candidates who

qualified under the 35% departmetnal quota (Ext. P-11) for training which

will cause irreparable injury to the applicant and others like him. The

applicant filed this Application on the grounds that there was no vacancy

notified under the general category, the examination on 30.4.2000 was

conducted without inviting application from general category candidates,

the general category candidates who qualified in the test conducted on

31.4.2000 are not eligible to appear in the test for want of educational

qualifications and the applicant and other similarly situated persons have a

right to participate in the examination. Hence he filed this O.A. for a

declaration that the candidates who qualified in the 35% qualifying quota of

1996 Recruitment Rules are not eligible to be appointed to the JTO

vacancies of 2003-04, to conduct a fresh examination under the

appropriate Recruitment Rules and to comply with the reservation rules

before filling up the vacancies.



3. Per contra, the respondents submitted that though the notification

for the screening test was issued on 10.11.1998 as per the 1996

Recruitment Rules, but due to some administrative reasons it was

postponed thrice and finally held on 30.4.2000. They submitted that the

vacancies upto 31.8.1999 were only notified and 41 vacancies for SC, 25

vacancies for ST were reserved. However, OC candidates were also

permitted to appear for the test on the condition that their selectiion will be

provisional and subject to availability of vacancies arising on the outcome

of the decision of various pending court cases. Out of the 621 candidates

qualified, 20 belonged to SC and none to ST. All the 20 SC qualified

candidates were promoted as JTO after training. As a number of posts

remained unfilled due to non-availability of sufficient number of qualified

hands and that large number of qualified candidates were in queue

waiting for their turn for training and posting, the BSNL took an

administrative decision to divert each year 500 vacant posts of JTOs from

direct recruitment quota upto 31.8.1999 to 35% departmental quota on all

India basis. All these posts were sanctioned exclusively for giving

promotion to the qualified candidates in the screening test held on

30.4.2000. The applicant appeared for the screening test held on

30.4.2000 but could not qualify. He along with other failed candidates

filed WA NO. 17292/03 before the High Court to review the results

applying relaxed standard which is still pending. There was no qualified

SC/ST candidate waiting for appointment and that the vacancies

earmarked for SC/ST are still lying vacant.



4 The applicant filed rejoinder reiterating that the new Rules came

into force w.e.f. 1.9.1999 and that the diversion of vacancies is against the

Recruitment Rules. The applicant submitted that filling up of the diverted

vacancies of 2003-04 with those not having the minimum educational

qualification without conducting fresh examination is violative of Articles 14

and 16 of the Constitution.



5 We have heard the learned counsel for the parties at length and

gone through the pleadings carefully.



6 The thrust of the argument of the learned counsel of the applicant

is that, had the examination held on 30.4.2000 was conducted in

accordance with the new Recruitment Rules of 1999, the reservation rules

are followed and had the applicant and similarly situated candidates been

given another opportunity to appear in the examination, the applicant

would have got a chance of qualifying the screening test.



7 The sum and substance of the argument of the learned counsel of

the respondents is that the notification was published on 10.11.1998 for the

vacancies from 1995 to 1998 before the new Recruitment Rules 1999

came into force but the examination could be held only on 30.4.2000

because of administrative reasons and that 21 SC and 25 ST posts are

lying vacant for want of qualified candidates, the applicant participated in

the screening test held on 30.4.2000 but did not qualify and that as large

number of qualified hands are remaining in queue waiting for their turn for

training the BSNL took a policy decision to divert each year 500 posts per

year for three years from direct recruitment quota vacancies to 35%

departmetnal quota on all India basis.



8. We notice that the question of diversion of direct recruitment

quota vacancies to 35% promotion quota has been challenged in various

courts/tribunals and that all the appointments have been made

provisionally subject to the outcome of decisions of the cases. It is also

brought to our notice that employees who are otherwise eligible to be

considered for promotion in the 15% promotion quota available to

departmental competitive examination quota have challenged the decision

of the BSNL to make available the entire diverted vacancies to one set of

departmental candidates only ie. 35% promotion quota, as arbitrary and

violative of Article 14 of the Constitution of India. Writ Petition No.

1956/2006 which was filed with a prayer to consider the petitioners for the

vacancies which had arisen after 31.8.1999 under the 15% departmental

competitive examination quota was disposed of by the High Court of Kerala

in February, 2008 directing the respondents to consider the case of the

petitioners therein against the vacancies which had arisen subsequent to

31.8.1999 in accordance with law and in accordance with Rules which were

prevailing on the date of occurrence of the vacancies. During argument,

the learned counsel for the respondents submitted that in view of the

decision of the High Court of Haryana and Punjab in CWP No. 5608/2007

the BSNL re-considered the matter and decided to do away with diversion

of vacancies under the 50% direct recruitment quota to 35% promotion

quota and the direct recruitment quota posts already stood re-diverted to

direct recruitment quota and that as a special measure decided to adjust

those officials who have already been promoted against the above said

diverted posts in supernumerary posts and would be kept as a separate

group and will not be a part of the regular sanctioned strength of JTOs.

Therefore, promotional aspects of those officials who are eligible for

consideration under the Recruitment Rules of JTO 2001 are not diminished

in any manner. The whole matter is now pending before the Apex Court

in SLP.



9. In this view of the matter, we record the submission of the learned

counsel for the respondents at the bar that as things stand now, the

challenge against filling up of vacancies diverted from direct recruitment

quota will not survive. The promotional aspects of those officials who are

eligible for consideration under the new Recruitment Rules will not be

affected adversely. In the facts and circumstances of the case, we are of

the view that nothing survives in this application. Accordingly we close

the TA. No costs.

We hope that The kerela court verdict i.e fixation of pay in 9850-14600 under FR 22 (1) a (1) without any restriction under FR (35) to officiating JTOs, on finding that the officials fulfill all the eligibility criteria for promotion as JTO as per relevant recruitment rule should be implemented to all over India and that our association will leave no stone unturned to make this possible.

The promotion policy in DOT/DTS/BSNL is as follows
Mechanic--->Technician--->TTA--->JTO.

The JTO(O) has always and will abide by the promotional avenue.We never went against the rules,the only thing is that we want our designation which is perfectly legal and true.The saddest part is that we had been promoted from TTA designation, but now they(SNATTA) have turned against us.In these circumstances they(TTA's) are forgetting their promotion policy as per service condition and are simply filing cases which do not yield anything and also do not benefit them.


The JTO(O) association BSNL India is very much grateful to all those who are supporting us.

Second battle won by JTO(O)!!!!!

Hon. Courts in Kerala passes judgment after a series of its proceedings to grant fixation of pay in 9850-14600 under FR 22 (1) a (1) without any restriction under FR (35) to officiating JTOs, on finding that the officials fulfill all the eligibility criteria for promotion as JTO as per relevant recruitment rule.


History of the issue:

1)BSNL C.O. passes order to restrict the pay of officiating JTOs under FR (35) in 2005. Accordingly the pay which was fixed under FR 22 (1) .a.(1) in the pay scale of 9850-14600 was with drawn.

2)The above decision was challenged in 16 Nos of different Writ Petitions ( W.P ( C ):28349, 35263, 35439, 35481, 35498, 35501, 35663, 35667, 35668, 35724, 35725, 35726, 35903, 35917, 35938 of 2005 and W.P ( C ).67/2006 at Single Bench of Hon. High Court of Kerala in the year 2005 and 2006.

3)Hon. High Court passed order in 2006 to “ grant the fixation of pay in 9850-14600 under FR 22 (1) a (1) without any restriction under FR (35)”, on finding that the officials fulfill all the eligibility criteria for promotion as JTO as per relevant recruitment rule.

4)BSNL filed W.A on the above judgment at Division Bench of the same court in the year 2006 to quash the judgment.

5)Division Bench disposed the review in 2007 directing “to pass appropriate order by CMD after giving an opportunity of being heard on the objections filed by BSNL by the representatives of officiating JTOs as well as administration”.

6)CMD invited for personal hearing in 2007, Com.Michael.P.M and Com.Sebi Louis of Kerala circle attended the hearing by CMD at C.O New Delhi on 18th Sept 2007.

7)BSNL again passed order to re-fix the pay under FR (35) to Officiating JTOs in 2007.

8)The above decision again challenged in different Contempt Petitions in 2007 at Single Bench of Hon. High Court of Kerala. All these cases are later transferred to Hon. Central Administrative Tribunal, Kerala in 2008 in TA No:84, 85, 86, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, 97 of 2008).

9)Hon. Central Administrative Tribunal, Kerala passed its judgment on 15-7-2009 allowing earlier judgment of High Court and directing for the fixation of pay in 9850-14600 under FR 22 (1) a (1) without any restriction under FR (35), on finding that the officials fulfill all the eligibility criteria for promotion as JTO as per relevant recruitment rule.

07-07-2009,New Delhi meeting

A delegation headed by Mr Kabeer Das met Hon'ble Minister of Communication Shri A.Raja.Mr Adam,Mr P.S.Chanda also took part in the meeting. The Hon'ble Minister of Communication A.Raja instructed to Shri R.K Chandolia(P.S to MOC) to immediately issue the orders to resolve our case i.e TTA's to JTO's promotion one time measure personal upgradation.

The CDR/Clarity project was launched successfully by BSNL in which our JTO(O) are also involved.Special thanks to Mr T.Radharaman JTO(O) who is one of the incharge for CDR clarity in HTD.We on behalf of JTO(O) congrates T.Radharaman.

The Tamil Nadu JTO(O) members Shri Manikandhan & others met Shri Venkat Raman Staffside leader national council discussed about our TTA's to JTO's promotion one time measure upgradation.Shri Raman responded positively.Shri Subburaman G.S TEPU also assured that our issue will be taken seriously as early as possible.

National Counsel Meeting in our Central HQ.

The National Counsel Meeting which was held on 23-06-2009 at corporate office New Delhi.Our issue i.e TTA's to JTO's promotion item no 11 was discussed seriously by Shri Suresh Kumarji G.S BSNL MS and Shri Venkatraman, leader of staff side national counsel member and others also supported for personal up gradation of JTO's. The management committee told that our issue is in the jurisdiction of court and SLP also filed in Supreme Court.
THe final conclusion drawn in the meeting was that our issue TTA's to JTO's promotion will be sent for legal opinion.
Our association is very much thankful to all the National counsel members

The service condition for relaxation from 10 years to & years for TTA's to JTO's was also discussed and this issue would be reviewed by the management committee.

The corporate office is going to change all the names of the cadre designations as follows.

The Supreme court notice has been served induvidually by hand to repondents including CMD B.S.N.L. Out of ten respondents one is left from Dept. and another one is promoted as JTO to Manali. All this notices served by Shri U.K.Thripati JTO U.P East.After receivin this notice within 30 days the respondents should submit their affidavit in the Supreme Court of India.

Due to 5608/2007 court case 136/2008 and contempt application no COCP No 1431/2008
there will be neither induvidual benefit nor the association's benefit.Because of these cases our B.S.N.L company's head of the family Shri Kuldeep Goyal attended the court resulting in the loss of 10 lakhs for the B.S.N.L.

Because of the above three cases, they resulted in filing of many other cases all over India.For e.g Himachal Pradesh, Andhra Pradesh, Kerela ,Punjab and Haryana, Tamil Nadu and New Delhi.

If the Management of B.S.N.L would have taken a right decision at that point of time in 2001 it wud'nt have resulted in the unnecessary filing of court cases which is an utter waste of time for both the 2173 officials all over India and the Management.We hope that we will see the light atleast now for one time measure upgradation for all TTA's to JTO(O)'s.

Its been a while that I have come over here since there were this general elections, summer vacation for the courts and even I was busy with some other works and hence I did not update any news but now as once again the dust has settled let us again concentrate on our central issue i.e One Time Upgradation of all the JTO(O)'s.

3)The service condition of 10 years to 7 years was rejected by the departmental committee(JTO-RR-2001)
4)The hyderabad delegation met Shri Prahlad Roy G.S AIBSNLEA on 30-04-2009 at Hyderabad and discussed about supernumerary and one time measure upgradation for 2173 officials all over India.Mr Prahlad Roy responded positively.
5)Shri Suresh Kumar G.S BSNLMS met Director HRD Shri Gopal Das and discussed about one time measure upgradation and supernumerary.

Court Case 136/2008

The Delhi principle CAT Court Case 136/2008 hearing was on today. The TA No. 578 departmental advocate Shri Agarwal and our advocate Shri Puneet Varma discussed matters regarding our issue. The petitioners advocate Shri Rani Chabra did not attend.Again the case will be posted on 26/05/2009.
The Maharashtra circle Aurangabad SSA meeting was held at CPO, IQ in the presence of central co-ordinator today and was a success.

The state coordinators of AP Shri Y. Ramakrishna Rao, Rajasthan, Shri P S .Chanda, Gujrath Shri R C .Manohar, ShriS.B.Parik, MP Shri Kshama dokale,Shri Bende, Shri .Gupta, Maharashtra, Shri B.D Vani , UP east, Shri.U K.Thripati, Shri K.K.Singh and central coordinator met in Delhi at T-15, ATUL GROVE ROAD NEW DELHI and discussed matters regarding one time meassure upgradation of JTO(O), promotion, and also met. Shri Suresh kumar G.S.BSNL,MS .The delegation also gave a representation to corporate office concerned officers including CMD.

JTO Promotion/supernumerary/meetings

A meeting was held at Madhurai(SSA) on 03-04-2009. 40 officers attended the meeting.State co-ordinator Shri Adam TN, Shekhar and Ramdin district co-ordinators attended the meeting.
In Gujrath, the meetings were held at Baruch(SSA), Baroda(SSA) and surat(SSA).The meetings were organised by Shri Y.V Patel, V.F.Christian, H.A>Patel, ANsari, Pandey, K.g.Nimarkar, J.M Limbachi, M.Patel, M.V Shaik.The State Co-ordinator Shri B.A,Rao addressed all the meetings.
In Andhra Pradesh emergency meetings took place at Eluru, Vishakapatnam, Nellore, Anantapur, Tirupathi, Nizamabad, Khammam, Kurnool, Vijaywada and Rajamundry.The meetings were conducted by District co-ordinators Shri Tilak, Niranjan, Sai Prabhakar, Pulliah, Allah Baksha Eramareddy, Muraikrishna, Venkatesh, Adinarayana, Hanuma Reddy, Raja Babu, Raju, Valli, Ravikumar, Dayanand, Ravindrababu, Kuppuswamy, Gurumurthy, Basha, Rami Reddy and others.
All the above meetings unanimously came to a conclusion that immediate promotion of JTO as one time measure/supernumerary.

2009/04/01

NEW DELHI/MEETINGS

The central coordination committee is going to NEW DELHI on 05/04/2009 for our long pending JTO promotion/(supernumerary).The committee will also meet CMD / director HRD /and concerned officials.All the state coordinators and SSA coordinators are requested to get in touch with central coordinator and treasurer.

Various meetings are being conducted in different circles like in Karnataka, the meeting will be held on 02/04/2009 at Bengaluru, Madhya Pradesh(MP), the meeting will held on 05/04/2009 at Bhopal, Gujrath the meeting will be held on 02/04/2009 at Ahmedabad regarding JTO promotion.

All 2173 officials of JTO(O) also should get arrears of 9850 scale on par with regular JTO's.There should not be any examination of LDCE in 35%.Also there should not be any relaxation of service condition from 10 years to 7 years.
Untill and unless clearance of the wait list JTO(O) all over india 14 circles.

MEETINGS/SEMINARS/CONVENTIONS/COURT CASES

Coimbatore SSA meeting(Tamil Nadu)/ERODE SSA
The Coimbatore meeting which was held in CTO building was a grand success. The ERODE meeting held in Telephone BHAVAN. ERODE At 18.00 HRS ON 21-03-09 was also a grand sucess. P.Chennakesavan,R.Adam,G.Thirumoorthy & R.Manikandan addressed the meeting.
The following resolutions were passed in both meetings..
1)Steps were taken for ONE TIME UPGRADATION from TTA's to JTO's.
2)Relaxation of service condition 10 years to 7years to BSNL TTA's should be stopped.
3)35% quota to BSNL TTA's should be challenged.
4)Extening full co-operation to CHQ.

Shri B.A Rao,R.C Manohar and Yogesh Pandey are conducting meetings in all SSA's everyweek and mobilising all the members regarding our regular promotion of JTO's.

The Andhra Pradesh state convention will be held on 29/03/2009 at Musheerabad exchange at 10:30 a.m. All the SSA coordinators and members are requested to attend the meeting and makna a grand success,'

COURTCASE
5608/2007 contempt courtcase hearing is expected on 29/04/2009.The BSNL management will submit the detail reports regarding diversion/supernumerary posts,
The Kerela court case of FR221A1 implementation of 9850 scale with increment on par with regular JTO's, The hearing is expected on 2/04/2009.

The CHQ are trying for one time measure upgradation/supernumerary posts by legal/unions.

All the officiating JTO's should take up the challenge to complete targets of 31/03/2009 for issue of landline, basic phones, FWT, MWT, broadband, EVDO, collection of pending dues and reconnections and make a point to improve our connections more than expectations.

HYDERABADMEETING/AP.STATEMEETING

The hyderabad meeting was held on 16-03-2009 at musheerabad exchange building. The meeting was started at 18:30hrs under the chairmenship of shri Y Ramakrishna Rao. The opening remarks and welcome address was given by Y.RK Rao and after that Mr Rajender Reddy gave his speech regarding Delhi trip, Mr Somaiah gave some suggestions regarding FR 26 and FR22(1)a(1) as per the FR and SR.all officiating officials may get increment in 9850 scale.Mr Prakash expressed his views regarding one time upgradation and not approaching to legal.Mr Srinivas gave his suggestions for supernumerary/one time measure and also suggests to take up this issue seriosuly with the Shri Suresh Kumar(G.S)BSNL Mazdoor Sangh and allied unions,Mr Shiva, Mr Ramkumar,Mr Krishnaiah,Mr Ramesh Babu,Mr Raghavender Rao,,Mr Radharaman, Mr Suryaprakash, Mr Nagabushnam, Mr T.Prabhakar, Mr Devender, Mr Siddique,Mr Ramganayakulu,Mr Pandarinath,Mr G.Kumar,Mr Anjireddy and many others requested for a meeting to be conducted on a state level basis in Hyderabad as early as possible.
Finally the central co-ordinator Kabeer Das explained detailed regarding court cases/supernumerary/one time measure upgradation,unions involvement, management status.
After the speech the following resolutions were passed
1)The chandigarh court case 5608/2007 should be challenged immediately
2)Relaxation of service conditions 10 years to 7 years ammending JTO RR also challenge
3)No departmental examination in 35% LDCE should not be held before regularisation of 2173 officials who are on officiating JTO's since 5 years
4)The AP state meeting will be conducted on 29/03/2009 at Hyderabad. The venue details will be intimated soon.
5)The SNATTA is humiliating the DOT recruitees TECHNICIANS/TTA's by underestimating their abilities, perhaps the SNATTA should be knowing that a building stands on the pillars.And i also want to state this fact that,"You don't kill your father just because he is old".
6)The JTO(O) officials challenging the work culture with SNATTA at any time,anywhere.Don't you remember the magnetotelephone to EVDO maintained by JTO(O) officiating officials,Do not forget the inventor(Graham Bell).

Qualification cannot dominate experience
The JTO(O) officials out of 2173, 90% of them are diploma holders,graduates,ITI and intermediate and many trainings taken in the department.Al are having minimum 20 years experience in the department.
7)All the JTO(O) will give their declaration for drawing arrears.
State Coordinators
1)all the state coordinators are requested to conduct meetings in every SSA and intimate to central coodinator
2) The TN meeting on 21/03/2009 at coimbatore Shri R Adam, Manikhandan, Chennkesavan and Babu are attending for the meeting/ on 27th tiruvanalai meeting Adam and others attending the same
3) The Gujrath meeting was conducted at Ahmedabad under the chairmenship of shri R.C.Manohar and B.A.Rao.The meeting was a grans success and important resolutions were taken to strengthen the central body.
4)The Rajasthan State co-ordinator shri P.S.Chanda is mobilising entire state .
5) The M.P state coordinato Hemanth Arora , Kshama Dokhle Ravi krishnan also mobilising entire circle.
6)The karnataka state co-ordinator Ramchander Rao and Manjunath also mobilising the entire circle
7)The Maharashtra state co-ordinators B.D.Vani,Parnerkar,Patil,Talikutty,Naik,Diksheeth mobilising all SSA's.
